APPLICATION by Chemin de fer de la Matapédia et du Golfe Inc. pursuant to section 32 of the Canada Transportation Act, S.C., 1996, c. 10, to vary Order No. 1995-R-452 of the National Transportation Agency of Canada dated October 30, 1995, to add to the order the name of Sylvie Tremblay as a third applicant, for the road crossing at mileage 68.71 Mont-Joli Subdivision, in the municipality of Val-Brillant, in the province of Quebec.

On October 11, 2005, the Chemin de fer de la Matapédia et du Golfe Inc. (hereinafter the railway company) filed with the Canadian Transportation Agency (hereinafter the Agency) the above-mentioned application, indicating that the parties were in agreement with the application.
On November 21, 2005, the railway company filed submissions in support of its application.
On November 29, 2005, Sylvie Tremblay, Rachel Fournier and Aline Nicole confirmed that they agreed with the application and that the maintenance costs should be shared by Sylvie Tremblay, Rachel Fournier and Aline Nicole.
The Agency has reviewed the submissions filed and has found, pursuant to section 32 of the Canada Transportation Act (hereinafter the CTA), that there has been a change in the facts or circumstances pertaining to Order No. 1995-R-452 since it was issued and that this Order should be varied.
Accordingly, the Agency, pursuant to section 32 of the CTA, hereby varies Order No. 1995-R-452 dated October 30, 1995 by deleting clause 3 and replacing it with the following:
"3. The cost of maintaining the private crossing and the approaches to the crossing shall be paid by the applicants and Sylvie Tremblay".
