APPLICATION by El Al Israel Airlines Ltd. pursuant to subsection 69(1) of the Canada Transportation Act, S.C., 1996, c. 10, as amended, for a licence to operate a scheduled international service between Israel and Canada.

El Al Israel Airlines Ltd. (El Al) has applied to the Canadian Transportation Agency (Agency) for the authority set out in the title.

Under Licence No. 090012, El Al is authorized to operate a scheduled international service, in a manner consistent with the Agreed Minute between Israel and Canada signed on February 17, 2009.

Condition No. 3 of Licence No. 090012 states:

This licence, unless cancelled at an earlier date, shall be in effect until March 27, 2010.

By Order No. 2009-A-544, the Agency, pursuant to paragraph 80(1)(c) of the Canada Transportation Act (CTA) exempted El Al from the application of section 59 of the CTA, permitting it to sell, cause to be sold or publicly offer for sale in Canada a scheduled international service between Israel and Canada for travel beyond March 27, 2010, subject to certain conditions.

By the Agreed Minute, signed February 22, 2010, Israel and Canada agreed on arrangements for the operation of scheduled international services for a period of one year until the end of the IATA 2010-2011 winter season.

El Al has been designated by the Government of the State of Israel to operate a scheduled international service between Israel and Canada.

The Agency finds that El Al meets the requirements of paragraph 69(1)(a) of the CTA.

Concerning the duration of the subject authority, the Agency considers it appropriate to grant the authority until March 26, 2011.

Accordingly, the Agency will issue to the applicant a licence to operate a scheduled international service between Israel and Canada.

Pursuant to subsection 71(1) of the CTA, the Agency deems the terms and conditions set out below to be consistent with the Agreement and will therefore include them in the licence to be issued pursuant to this Decision.

The licence to be issued pursuant to this Decision shall be subject, in addition to the conditions prescribed by the Air Transportation Regulations, SOR/88-58, as amended (ATR), to the requirements to hold a Canadian aviation document issued by the Minister of Transport and to have prescribed liability insurance coverage as set out in section 7 of the ATR, and to the following terms and conditions to which the licence is made subject pursuant to subsection 71(1) of the CTA:

  1. The Licensee is authorized to operate a scheduled international service in a manner consistent with the Agreed Minute between Israel and Canada signed on February 22, 2010.
  2. The operation of the scheduled international service authorized shall be conducted subject to the provisions of any applicable arrangements as may be agreed to between Israel and Canada.
  3. This licence shall terminate on March 26, 2011.

Any similar request for a subsequent authority shall be submitted to the Agency for approval by no later than February 25, 2011.
