Contravention

A) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), the undersigned enforcement officer has issued this notice of violation believing Air Canada has committed 9 violations of failing to provide, free of charge, alternate travel arrangements to passengers (28M5QA), (2TEB26), (36HX72), et (3DOY4A), whose flights (AC8163), (AC235), (AC912), and (AC128) were cancelled for reasons within the carrier's control, including when required for safety, to ensure the passengers completed their itinerary as soon as feasible, in the form of a confirmed reservation on the next available flight that it operated or with a carrier with which it had a commercial agreement and that was traveling on any reasonable air route, from the airport at which the passenger was located to the destination indicated on the passenger’s original ticket and was departing within nine hours of the departure time indicated on that original ticket, thereby contravening subparagraph 17(1)(a)(i) of the Air Passenger Protection Regulations.

These contraventions occurred between November 16, 2022 to December 25, 2022.

B) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), the undersigned enforcement officer has issued this notice of violation believing Air Canada has committed 7 violations following flight cancellations (AC8254), (AC8163), and (AC8351), within the carrier's control, including for safety, Air Canada failed to refund within 30 days, the unused portions of a ticket to passengers (4OWMVK), (28M5QA), and (2SMB4N), who chose not to complete their itinerary with the alternate travel arrangements provided in accordance with paragraph 17(1)(a) of the Air Passenger Protection Regulations, which did not accommodate their travel needs, thereby contravening subsection 18.2(2) of those regulations.

These contraventions occurred between December 6, 2022 to December 17, 2022.

C) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), the undersigned enforcement officer has issued this notice of violation believing Air Canada has committed 8 violations following flight cancellations (AC2014), (AC008), and (AC1705) outside the carrier's control, Air Canada failed to refund within 30 days, the unused portions of a ticket to a passengers (2UDWMO), (2VF72B), and (23UTEJW), who chose not to complete their itinerary with the alternate travel arrangements provided in accordance with subsection 18(1.1) of the Air Passenger Protection Regulations, thereby contravening subsection 18.2(2) of those regulations.

The contraventions occurred between January 20, 2023 to January 27, 2023
