Contravention
1. On or about February 28, 2024, Air Canada failed to provide passengers, who were denied boarding on flight AC481, with the information referred to in subsection 13(1) using the available communication method for which they indicated a preference, including a method that is compatible with adaptative technologies intended to assist persons with disabilities, thereby contravening subsection 13(5) of the Air Passenger Protection Regulations.
2. On or about February 28, 2024, Air Canada denied boarding to passengers, for a reason that is within carrier’s control but required for safety purposes, without first asking all passengers if any would be willing to give up their seat, thereby contravening subsection 15(1) of the Air Passenger Protection Regulations.
3. On or about February 28, 2024, when denial of boarding was necessary, Air Canada failed to give priority for boarding to passengers, passengers who were travelling with family members, when selecting passengers who would be denied boarding, thereby contravening subsection 15(4) of the Air Passenger Protection Regulations.
