Contravention

(1) On or about January 23, 2024, Etihad Airways P.J.S.C. failed to make available, in simple, clear and concise language, on a document on which the itinerary of the passenger appears, the terms and conditions referred to in subsection 5(1) of the Air Passenger Protection Regulations (APPR), thereby contravening subsection 5(2) of the APPR.

(2) On or about January 23, 2024, Etihad Airways P.J.S.C. failed to provide, in simple, clear and concise language, on a document on which the itinerary of the passenger appears, information on the treatment of passengers and minimum compensation owed by the carrier and the recourse against the carrier available to passengers, including their recourse to the Agency, thereby contravening subsection 5(3) of the Air Passenger Protection Regulations.

(3) On or about January 23, 2024, Etihad Airways P.J.S.C failed to make available the prescribed notice pursuant to subsection 5(5) of the Air Passenger Protection Regulations (APPR), on a document on which the itinerary of the passenger appears, thereby contravening that subsection of the APPR.

(4) On or about March 28, 2024, Etihad Airways P.J.S.C failed to provide passengers affected by the delay of flight EY140 scheduled to depart on March 28, 2024, the compensation to which they may be entitled to for inconvenience, the standards of treatment for passengers, and the recourse available against the carrier, including recourse to the Agency using the available communication method for which they had indicated a preference, thereby contravening subsection 13(5) of the Air Passenger Protection Regulations.

(5) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), the undersigned enforcement officer has issued this notice of violation believing Etihad Airways P.J.S.C. has committed the following 29 violations, did not provide passengers with the minimum compensation referred to in subsection 19(1) or 19(2) of the Air Passenger Protection Regulations or an explanation as to why compensation is not payable, within 30 days after the day on which it received the passenger's request, thereby contravening subsection 19(4) of those regulations.

These contraventions occurred between April 29, 2024 and May 17, 2024
