ORDER NO. 1995-R-517

IN THE MATTER OF an application by the Canadian National Railway Company (hereinafter CN) pursuant to section 160 of the National Transportation Act, 1987, R.S.C., 1985, c. 28 (3rd Supp.) (hereinafter the NTA, 1987) for authority to abandon the operation of the segment of the Newmarket Subdivision from Dykstra (mileage 226.8) to a point near North Bay (mileage 228.9) (hereinafter the branch line), a total distance of 2.1 miles, in the province of Ontario; and

IN THE MATTER OF an application by CN for rescission of Order No. 1993-R-356 dated November 19, 1993 pursuant to subsection 172(1) of the NTA, 1987.

WHEREAS by Order No. 1993-R-356 dated November 19, 1993, the National Transportation Agency (hereinafter the Agency) authorized CN to abandon the operation of the branch line on July 1, 1994;

AND WHEREAS by letters dated June 27, 1994 and November 19, 1994, the date of the abandonment of the operation of the branch line was postponed to July 1, 1995;

AND WHEREAS by letter dated June 8, 1995, the applicant requested the rescission of Order No. 1993-R-356 since the CNCP Ottawa Valley Partnership has been terminated;

AND WHEREAS the Agency determines that the retention of the Newmarket Subdivision is required for CN's continued operations in the Ottawa Valley.

NOW THEREFORE, IT IS ORDERED THAT:

Order No. 1993-R-356 dated November 19, 1993 is hereby rescinded pursuant to subsection 172(1) of the NTA, 1987.

This Order takes effect on June 27, 1995, the date on which the decision of the Agency was communicated by letter to the parties of record.
