Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA), a designated enforcement officer has issued a notice of violation believing WestJet has committed 68 violations after being unable to provide a confirmed reservation in accordance with subsection 18(1), failed to, at the passenger’s choice, refund any unused portion of the ticket or provide alternate travel arrangements, free of charge, namely, in the case of a large carrier, a confirmed reservation for the next available flight that is operated by any carrier and is travelling on any reasonable air route from the airport at which the passenger is located, or another airport that is within a reasonable distance of that airport, to the destination that is indicated on the passenger’s original ticket and if the new departure is from an airport other than the one at which the passenger is located, transportation to that other airport, contrary to the paragraph 18(1.1)(a) of the Air Passenger Protection Regulations.

These violations occurred between June 29, 2024, and July 3, 2024.

On or about February 11, 2025, Porter Airlines (Canada) Limited advertised the price of an air service in an advertisement on Instagram without including the point of origin and point of destination of the service and whether the service is one-way or round-trip, thereby contravening paragraph 28(1)(b) of the Air Passenger Protection Regulations.

(A) On or about June 19, 2024, at Calgary International Airport (YYC), EW Discover GmbH dba Discover Airlines, failed to provide the passengers, by means of an audible announcement, the reason for the delay for flight number 4Y073, thereby contravening subsection 13(4) of the Air Passenger Protection Regulations.

(B) On or about June 19, 2024, EW Discover GmbH dba Discover Airlines, failed to provide a passenger, affected by the delay of flight 4Y073 scheduled to depart on June 19, 2024, the reason for the delay using the available communication method for which he had indicated a preference, including a method that is compatible with adaptive technologies intended to assist persons with disabilities, thereby contravening subsection 13(5) of the Air Passenger Protection Regulations.

Air Canada

1. On or about February 28, 2024, Air Canada failed to provide passengers, who were denied boarding on flight AC481, with the information referred to in subsection 13(1) using the available communication method for which they indicated a preference, including a method that is compatible with adaptative technologies intended to assist persons with disabilities, thereby contravening subsection 13(5) of the Air Passenger Protection Regulations.

2. On or about February 28, 2024, Air Canada denied boarding to passengers, for a reason that is within carrier’s control but required for safety purposes, without first asking all passengers if any would be willing to give up their seat, thereby contravening subsection 15(1) of the Air Passenger Protection Regulations.

3. On or about February 28, 2024, when denial of boarding was necessary, Air Canada failed to give priority for boarding to passengers, passengers who were travelling with family members, when selecting passengers who would be denied boarding, thereby contravening subsection 15(4) of the Air Passenger Protection Regulations.

1. On or about March 20, 2024, Delux Public Charter, LLC (doing business as JSX Air and JetsuiteX Air) operated an air service using an Embraer E-135 type aircraft bearing registration N263JX from Seattle, Washington, USA (BFI) to Calgary, Alberta, Canada (YYC) without holding a licence issued under Part II of the Canada Transportation Act (CTA), thereby contravening section 57 of the CTA.

2. On or about March 21, 2024, Delux Public Charter, LLC (doing business as JSX Air and JetsuiteX Air) operated an air service using an Embraer E-135 type aircraft bearing registration N263JX from Calgary, Alberta, Canada (YYC) to Seattle, Washington, USA (BFI) without holding a licence issued under Part II of the Canada Transportation Act (CTA), thereby contravening section 57 of the CTA.

Med Jets, S.A. de C.V. carrying on business as Jet Rescue Air Ambulance

(A) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA) the undersigned Enforcement Officer has issued this notice of violation believing Med Jets, S.A. de C.V. carrying on business as Jet Rescue Air Ambulance has committed 8 violations, operated an air service using a Learjet 60 type aircraft bearing registration XA-CST, departing from and arriving at different locations without holding a Canadian aviation document thereby contravening paragraph 57(b) of the Canada Transportation Act.

These violations occurred between January 10, 2024 and February 22, 2024.

(B) Pursuant to section 180 of the Canada Transportation Act, SC 1996, c 10 (CTA) the undersigned Enforcement Officer has issued this notice of violation believing Med Jets, S.A. de C.V. carrying on business as Jet Rescue Air Ambulance has committed 13 violations, operated an international passenger charter, using an aircraft bearing registration XA-CST, departing from and arriving at different locations, which was not authorized by the terms and conditions to which its license is subject, thereby contravening subsection 74(2) of the Canada Transportation Act.

These violations occurred between January 10, 2024 and February 22, 2024.

Pakistan International Airlines

(A) On or about December 23, 2024, Pakistan International Airlines Corporation advertised the price of an air service on their mobile application without setting out all third party charges under the heading “Taxes, Fees and Charges”, thereby contravening subsection 28(2) of the APPR.

(B) On or about December 23, 2024, Pakistan International Airlines Corporation provided information in an advertisement on the website www.piac.com.pk in a manner that could interfere with the ability of anyone to readily determine the total price that must be paid for optional incidental services, thereby contravening section 29 of the APPR.

(C) On or about December 23, 2024, Pakistan International Airlines Corporation referred to a third party charge in an advertisement on their mobile application by a name other than the name under which it was established, thereby contravening section 31 of the APPR.

On or about March 2, 2024, WestJet failed to provide passengers affected by the cancellation of flight WS1474 scheduled to depart on March 2, 2024, the information referred to in subsection 13(1) using the available communication method for which they had indicated a preference, including a method that is compatible with adaptive technologies intended to assist persons with disabilities, specifically by email, thereby contravening subsection 13(5) of the Air Passenger Protection Regulations.

On or about March 2, 2024, WestJet failed to provide, free of charge, alternate travel arrangements to passengers, whose flight (WS1474) was cancelled for reasons outside carrier's control, in the form of a confirmed reservation for the next available flight that it operated or with a carrier with which it had a commercial agreement, and that was travelling on any reasonable air route from the airport at which the passenger was located to the destination indicated on the passenger’s original ticket and was departing within 48 hours of the departure time indicated on that original ticket, thereby contravening subsection 18(1) of the Air Passenger Protection Regulations.
