Results of an investigation initiated on December 19, 2017 by a designated enforcement officer of the Canadian Transportation Agency indicate that WestJet made public statements contrary to and resulting in a contravention of subsection 18(b) of the Air Transportation Regulations.

Such public statements, to passengers, were made in relation to scheduled flights being cancelled due to apparent airport closures in but not limited to the areas of Santa Clara, Cuba and Turks and Caicos Islands when in fact the airports in question were in an open status.

(A)  On or about May 10, 2018, the Kelowna International Airport failed to ensure that all their employees and contractors who are required by these Regulations to receive training complete their initial training within 60 days after the commencement of their duties thereby violating section 8 of the PTR.

(B) On or about May 10, 2018, the Kelowna International Airport failed to ensure that all their employees and contractors receive periodic refresher training sessions appropriate to the requirements of their function, thereby violating section 9 of the PTR.

(C) On or about May 10, 2018, the Kelowna International Airport failed to keep available for inspection by the Agency and the general public a copy of its current training program prepared in the form set out in the schedule and containing the information required therein, thereby violating section 11 of the PTR.
