(1) On or about December 3, 2022, at Victoria International Airport, WestJet refused to accept the mobility aid of a person with a disability (HPFMQQ) who needed the mobility aid during travel on flight WS3260, thereby contravening subsection 40(1) of the Accessible Transportation for Persons with Disabilities Regulations (ATPDR). (2) On or about December 3, 2022, at Victoria International Airport, WestJet refused to transport a person with a disability (HPFMQQ) on flight WS3260, thereby contravening subsection 60(1) of the Accessible Transportation for Persons with Disabilities Regulations (ATPDR). (3) On or about December 14, 2022, WestJet failed to provide a written notice, within 10 days, to a person with a disability (HPFMQQ) that set out the reasons for the refusal to transport the mobility aid of the person on flight WS3260 on December 3, 2022, thereby contravening subsection 48(a) of the Accessible Transportation for Persons with Disabilities Regulations (ATPDR). (4) On or about December 14, 2022, WestJet failed to provide a written notice, within 10 days, to a person with a disability (HPFMQQ) that set out the reasons for the refusal to transport that person on flight WS3260 on December 3, 2022, thereby contravening subsection 60(2) of the Accessible Transportation for Persons with Disabilities Regulations (ATPDR). |
